Update
As you know, the outcome of the court case was:

Now this putz thought he would give me the run-a-round, which he did, but I perservered and instead of heading back to court (which I would have done without a doubt).....

So the moral of this one is.... never be afraid to stand up for your rights and never take crap from stores like this. Never back down!! You can sue, you can sue free of charge in Ontario as long as you fill in the correct form and have documentation that you're disabled. You can also have your small claims case heard via phone if you provide the proper documentation and the Judge agrees. It's another form to fill out however much worth it. They filled the form out for me over the phone which was very nice of them, normally you have to pick it up and fill it out.

The City Optical employee that was so smug and laughed when I said I was going to sue, no longer works there, she was fired.

Oh, speaking of employee's, the best part of this was I was allowed to serve them the legal suit papers myself. You also have the ability to serve them the legal papers yourself. You do not have to have a Sheriff do it for you. As long as you have the person in charge accept the papers, everything is Kosher. :-)

I cannot tell you how good it felt to go into that store, ask for the person in charge, when she came to me, verifying she was in charge, handing her the envelope and telling her she's been served. Then left. :-) Even if that was all that happened, it was very satisfying in and of itself. She opened it as I was leaving and you should have seen her face.

Btw, throughout this ordeal I was never nasty, vulgar, and always kept my composure. It's not necessary to swear, bellow, accuse, etc. Keep calm, it shows you're a decent person just trying to get what is rightfully yours. Unlike some putz that has sent me 40 emails in a few days chasing after Pizza Pizza and when I didn't agree with him on another disabled related matter he wrote me such a vile email that I can't print it here online. Well, I could, but I won't. :-)
